ADOLYGIAD O DRWYDDED I YRRU CERBYDAU HACNI A CHERBYDAU HURIO PREIFAT - GYRRWR RHIF 15/1124/TXJDR

Ystyried adroddiad cyfrinachol gan y Pennaeth Cynllunio a Diogelu’r Cyhoedd (copi ynghlwm) yn gofyn i aelodau adolygu trwydded i yrru cerbydau hacni a cherbydau hurio preifat o ran Gyrrwr Rhif 15/1124/TXJDR.

Penderfyniad:

PENDERFYNWYD diddymu trwydded yrru cerbydau hacni a cherbydau hurio preifat gyrrwr rhif  15/1124/TXJDR ar sail diogelwch y cyhoedd ar unwaith.

 

Cofnodion:

Cyflwynwyd adroddiad cyfrinachol gan y Pennaeth Cynllunio a Gwarchod y Cyhoedd (a ddosbarthwyd yn flaenorol) ynglŷn ag –

 

(i)        addasrwydd Gyrrwr Rhif

(ii)        15/1124/TXJDR i ddal trwydded i yrru cerbydau hacni a cherbydau hurio preifat yn dilyn cronni 40 o bwyntiau cosb o dan gynllun pwyntiau cosb y Cyngor am gyflwyno cerbyd trwyddedig i’w brofi mewn cyflwr anniogel a pheryglus ddwywaith;

(iii)      roedd y Gyrrwr wedi ymddangos gerbron y Pwyllgor Trwyddedu ar 10 Mehefin 2015 yn dilyn croniad o 20 pwynt cosb ar gyfer cyflwyno cerbyd trwyddedig i’w brofi mewn cyflwr anniogel a pheryglus, a oedd wedi arwain at ataliad dros dro o bythefnos;

 

(iv)      Roedd manylion y diffygion a nodwyd yn dilyn cyflwyno’r cerbyd am brawf Cydymffurfio/MOT ym mis Ebrill 2016 a chyhoeddi 20 o bwyntiau cosb ychwanegol wedi'u cynnwys yn yr adroddiad ynghyd â datganiadau tyst a dogfennau cysylltiedig;

 

(v)       roedd y Gyrrwr wedi cyflwyno tystiolaeth ddogfennol i gefnogi'r adolygiad o'i drwydded gan gynnwys Prawf MOT/Tystysgrif Cydymffurfio ar gyfer y cerbyd dyddiedig 19 Mai 2016, ynghyd â llythyr i apelio yn erbyn y pwyntiau cosb (gwrthodwyd yr apêl gan swyddogion ar ôl hynny), a

 

(vi)      the Driver having been invited to attend the meeting in support of his licence review and to answer members’ questions thereon.bod y Gyrrwr wedi cael ei wahodd i fod yn bresennol yn y cyfarfod i gefnogi’r adolygiad o’i drwydded, ac i ateb cwestiynau’r aelodau ynglŷn â hynny.

 

The Driver was in attendance and accompanied by his Union Representative.Roedd y Gyrrwr yn bresennol a daeth ei Gynrychiolydd Undeb gydag o. The Union Representative confirmed receipt of the report and committee procedures.Cadarnhaodd y Cynrychiolydd Undeb dderbyn yr adroddiad a'r gweithdrefnau pwyllgor.

 

The Licensing Enforcement Officer (LEO) outlined the case as detailed within the report.Amlinellodd y Swyddog Gorfodi Trwyddedu yr achos fel y manylwyd arnynt yn yr adroddiad. Whilst the vehicle had not been presented for retest at the time of writing the report members were advised that the vehicle had subsequently passed an MOT/Compliance Test on 19 May 2016.Er na chafodd y cerbyd ei gyflwyno ar gyfer ail brawf ar adeg ysgrifennu'r adroddiad, hysbyswyd yr aelodau bod y cerbyd wedi pasio Prawf MOT/Tystysgrif Cydymffurfio wedi hynny ar 19 Mai 2016.

 

The Union Representative presented the Driver’s case arguing that he had actively sought guidance and assurance regarding the vehicle’s condition.Cyflwynodd y Cynrychiolydd Undeb achos y Gyrrwr gan ddadlau ei fod wedi mynd ati i ofyn am arweiniad a sicrwydd ynglŷn â chyflwr y cerbyd. The vehicle had been presented for MOT testing on 4 April 2016 and repair work had been carried out which had resulted in an MOT Certificate being issued on 13 April 2016.  The vehicle had subsequently failed the MOT and Compliance Test at the Council’s Designated Testing Station on 14 April 2016 with a clear difference of opinion between the two vehicle examiners.Cyflwynwyd y cerbyd ar gyfer prawf MOT ar 4 Ebrill 2016, a chafodd gwaith atgyweirio ei wneud a arweiniodd at gyhoeddi Tystysgrif MOT ar 13 Ebrill 2016. Methodd y cerbyd yr MOT a’r Dystysgrif Gydymffurfiaeth wedi hynny yng Ngorsaf Brofi Ddynodedig y Cyngor ar 14 Ebrill 2016 gyda gwahaniaeth clir ym marn y ddau archwiliwr cerbyd. The Union Representative sought to highlight a number of inconsistencies in the report and put questions to the LEO in that regard.Ceisiodd y Cynrychiolydd Undeb dynnu sylw at nifer o anghysondebau yn yr adroddiad a chwestiynu'r LEO yn hynny o beth. In response the LEO clarified the extent of his involvement in the investigation and his reliance on the documentary evidence and statement provided by the Compliance Engineer who had carried out the test on 14 April 2016 which demonstrated that the vehicle had been presented for test in an unsafe, dangerous and poor condition.Mewn ymateb, eglurodd y LEO faint ei ran yn yr ymchwiliad a'i ddibyniaeth ar y dystiolaeth ddogfennol a’r datganiad a ddarparwyd gan y Peiriannydd Cydymffurfiaeth a oedd wedi cynnal y prawf ar 14 Ebrill 2016, a ddangosodd fod y cerbyd wedi cael ei gyflwyno ar gyfer prawf mewn cyflwr anniogel, peryglus a gwael.  With regard to the Driver’s conduct the Union Representative submitted that he had acted in good faith when presenting the vehicle for inspection on 14 April 2016 given that it had passed an MOT Test the previous day.O ran ymddygiad y gyrrwr, dywedodd y Cynrychiolydd Undeb ei fod wedi gweithredu'n ddidwyll wrth gyflwyno'r cerbyd i'w archwilio ar 14 Ebrill 2016, o ystyried ei fod wedi pasio Prawf MOT y diwrnod cynt. The Driver had submitted a number of receipts and invoices (circulated at the meeting) to demonstrate the vehicle repairs which had been carried out.Roedd y Gyrrwr wedi cyflwyno nifer o dderbynebau ac anfonebau (a ddosbarthwyd yn y cyfarfod) i ddangos y gwaith trwsio’r cerbyd a oedd wedi cael ei wneud. Reference was also made to a number of defects which had not been dealt with consistently during previous testing regimes.Cyfeiriwyd hefyd at nifer o ddiffygion na chawsant eu trin yn gyson yn ystod cyfundrefnau profi blaenorol. The differences between the mechanical fitness as evidenced by the MOT Test and the requirements of the Compliance Test were also highlighted.Amlygwyd y gwahaniaethau rhwng yr addasrwydd mecanyddol fel y dangosir gan y Prawf MOT a gofynion y Prawf Cydymffurfio hefyd. Concerns were also expressed by the Union Representative regarding the terminology used within the report when considering whether the Driver was fit and proper to hold a licence.Mynegwyd pryderon hefyd gan y Cynrychiolydd Undeb ynghylch y derminoleg a ddefnyddir yn yr adroddiad wrth ystyried p’un a yw’r Gyrrwr yn addas a phriodol i ddal trwydded.  Members clarified the reasoning behind the use of the standard phrase when determining fitness.Eglurodd yr Aelodau y rhesymeg y tu ôl i'r defnydd o'r ymadrodd safonol wrth benderfynu ar addasrwydd.  In closing his submission the Union Representative argued that the Driver had taken reasonable steps to ensure that his vehicle was compliant when it was presented for test on 14 April and he was clearly not a danger to the public.Wrth gloi ei gyflwyniad, dadleuodd y Cynrychiolydd Undeb fod y Gyrrwr wedi cymryd camau rhesymol i sicrhau bod ei gerbyd yn cydymffurfio pan gafodd ei gyflwyno ar gyfer prawf ar 14 Ebrill a'i bod yn amlwg nad oedd yn berygl i'r cyhoedd.

 

Members took the opportunity to question the Driver and his Union Representative on their submission and the facts of the case as they had been presented.Cymerodd yr Aelodau y cyfle i holi'r Gyrrwr a'i Gynrychiolydd Undeb ar eu cyflwyniad a ffeithiau'r achos fel y cawsant eu cyflwyno. Questions were asked regarding specific defects which had been identified and steps taken by the Driver to ensure that the vehicle was fit for purpose when transporting members of the public together with questions regarding its general use.Gofynnwyd cwestiynau ynghylch diffygion penodol sydd wedi eu nodi a'r camau a gymerwyd gan y Gyrrwr i sicrhau bod y cerbyd yn addas i'r diben ar gyfer cludo aelodau o'r cyhoedd ynghyd â chwestiynau ynglŷn â'i ddefnydd cyffredinol.  Assurances were also sought regarding lessons learned from when the Driver had last been before the committee in June 2015.  The Driver responded that he had presented his vehicle for an MOT Test at an earlier stage in order to address any outstanding issues prior to its submission for MOT/Compliance Testing at the Council’s Designated Testing Station.Gofynnwyd am sicrwydd hefyd ynglŷn gwersi a ddysgwyd o'r adeg pan y Gyrrwr wedi bod yn olaf cyn y pwyllgor ym mis Mehefin 2015. Ymatebodd y Gyrrwr ei fod wedi cyflwyno ei gerbyd ar gyfer prawf MOT yn gynharach er mwyn ymdrin ag unrhyw faterion sy'n weddill cyn ei gyflwyno am Brawf MOT/Cydymffurfiad yng Ngorsaf Brofi Ddynodedig y Cyngor.

 

The Union Representative took the opportunity to make a final statement.Cymerodd y Cynrychiolydd Undeb y cyfle i wneud datganiad terfynol. He submitted that the Driver had attempted to be careful by submitting the vehicle for MOT testing beforehand and had ensured that repair works were carried out which had resulted in the vehicle passing the MOT Test on 13 April 2016.  He argued that it was reasonable for the Driver to trust that the vehicle was compliant when submitting the same for an MOT/Compliance Test the following day.Dywedodd fod y Gyrrwr wedi ceisio bod yn ofalus drwy gyflwyno’r cerbyd ar gyfer prawf MOT ymlaen llaw ac wedi sicrhau bod gwaith atgyweirio yn cael ei gynnal, a oedd yn golygu bod y cerbyd yn pasio’r Prawf MOT ar 13 Ebrill 2016. Roedd yn dadlau ei bod yn rhesymol i'r gyrrwr feddwl bod y cerbyd yn cydymffurfio wrth gyflwyno’r un fath ar gyfer Prawf MOT/Cydymffurfiad y diwrnod canlynol.

 

The committee adjourned to consider the case and it was –Ar y pwynt hwn, gohiriodd y pwyllgor i ystyried yr achos a -

 

RESOLVED that the hackney carriage and private hire vehicle driver’s licence issued to Driver No.PENDERFYNWYD diddymu trwydded yrru cerbydau hacni a cherbydau hurio preifat gyrrwr rhif15/1124/TXJDR be revoked on public safety grounds with immediate effect. 15/1124/TXJDR ar sail diogelwch y cyhoedd ar unwaith.

 

The reasons for the Licensing Committee’s decision were as follows –Dyma oedd y rhesymau dros benderfyniad y Pwyllgor Trwyddedu –

 

Members had carefully considered the contents of the report together with the submissions presented for the Driver in this case and his response to questions.Roedd yr Aelodau wedi ystyried yn ofalus cynnwys yr adroddiad a’r sylwadau a gyflwynwyd gan y Gyrrwr yn yr achos hwn a’i ymateb i gwestiynau.

 

The committee did not consider the Driver to be a fit and proper person to hold a licence and resolved to revoke the licence on the grounds of public safety.Nid oedd y pwyllgor yn ystyried bod y Gyrrwr yn unigolyn addas a phriodol i ddal trwydded a phenderfynwyd diddymu'r drwydded ar sail diogelwch y cyhoedd.

 

The committee considered that the Driver had failed in his duty of care to his fee paying passengers.Ystyriodd y pwyllgor fod y Gyrrwr wedi methu yn ei ddyletswydd gofal i'w deithwyr sy’n talu ffioedd.  On his own admission, he used the vehicle to carry groups of people on a night out and to airports.Ar ei gyfaddefiad ei hun, defnyddiodd y cerbyd i gario grwpiau o bobl ar noson allan ac i feysydd awyr.

 

It was accepted that the Driver presented his vehicle for an MOT Test on 4 April 2016 whereupon it failed.Derbyniwyd bod y Gyrrwr wedi cyflwyno ei gerbyd ar gyfer prawf MOT ar 4 Ebrill 2016 ac ar hynny iddo fethu.  At this point the committee noted that this in itself demonstrated that the Driver had not maintained his vehicle to an acceptable standard.Ar y pwynt hwn, nododd y pwyllgor fod hyn ynddo'i hun yn dangos nad oedd y gyrrwr wedi cynnal ei gerbyd i safon dderbyniol.Subsequently, the Driver had some work undertaken on the vehicle and presented to the committee one receipt dated 13 April 2016.  On examination the committee determined that this had not addressed all of the issues which had resulted in the MOT failure on 4 April 2016.  The vehicle was subsequently retested on 13 April 2106 whereupon it passed. Yn dilyn hynny, cafodd y Gyrrwr rywfaint o waith wedi’i wneud ar y cerbyd, a chyflwynodd un dderbynneb i’r pwyllgor dyddiedig 13 Ebrill 2016. Wrth archwilio, penderfynodd y pwyllgor nad oedd hyn wedi mynd i’r afael â phob un o'r materion a arweiniodd at y methiant MOT ar 4 Ebrill 2016. Cafodd y cerbyd ei ail-brofi wedi hynny ar 13 Ebrill 2016, lle bu iddo basio. The vehicle was then presented for its Compliance Test and MOT Test at the Council’s Designated Testing Station.Yna cafodd y cerbyd ei gyflwyno ar gyfer ei Brawf Cydymffurfio a Phrawf MOT yng Ngorsaf Brofi Ddynodedig y Cyngor.  At this point the vehicle failed to pass either test, raising a number of serious defects identified on the vehicle.Ar y pwynt hwn methodd y cerbyd i basio’r ddau brawf, a nodwyd nifer o ddiffygion difrifol ar y cerbyd. As a result the vehicle licence was suspended and the Driver was unable to drive it as a Hackney Carriage or Private Hire Vehicle.O ganlyniad, cafodd trwydded y cerbyd ei wahardd ac ni allai'r Gyrrwr ei yrru fel Cerbyd Hacni na Cherbyd Hurio Preifat.

 

The Driver presented to the committee a number of receipts demonstrating that he had had work carried out on the vehicle.Cyflwynodd y Gyrrwr nifer o dderbynebau i’r pwyllgor, a ddangosodd ei fod wedi cael gwneud gwaith ar y cerbyd. On close inspection of these receipts it was evident that this work had been carried out on the vehicle between July 2015 and December 2015, some many months prior to it being presented for testing in April 2016.  Many of the issues and defects listed in both the MOT Test and the Compliance Test, in the opinion of the committee, would have been visible and apparent to a lay person, let alone a professional driver.O edrych yn agos ar y derbynebau hyn, roedd yn amlwg bod y gwaith hwn wedi cael ei wneud ar y cerbyd rhwng mis Gorffennaf 2015 a mis Rhagfyr 2015, rai misoedd lawer cyn iddo gael ei gyflwyno i'w brofi ym mis Ebrill 2016. Byddai nifer o'r materion a’r diffygion a restrir yn y Prawf MOT a'r Prawf Cydymffurfio, ym marn y pwyllgor, wedi bod yn weladwy ac amlwg i leygwr, heb sôn am yrrwr proffesiynol.

 

The committee also took into consideration the fact that the Driver had been issued with 20 penalty points the previous year for the condition of his vehicle at that time, and for which he was issued with a two week suspension.Ystyriodd y pwyllgor hefyd y ffaith bod y Gyrrwr wedi cael 20 o bwyntiau cosb y flwyddyn flaenorol am gyflwr ei gerbyd ar y pryd, ac fe’i gwaharddwyd am bythefnos.  The committee was satisfied that the Driver had taken insufficient steps to maintain the integrity and safety of his vehicle, which was borne out by the defects found.Roedd y pwyllgor yn fodlon nad oedd y Gyrrwr wedi cymryd camau digonol i gynnal cywirdeb a diogelwch ei gerbyd, a gadarnhawyd gan y diffygion. The Driver had a duty to ensure that his vehicle stood up to scrutiny particularly in the event of an accident.Roedd gan y Gyrrwr ddyletswydd i sicrhau bod ei gerbyd yn cefnogi craffu yn enwedig pe byddai'n cael damwain. If he knew there were defects, and in the opinion of the committee it was felt that many of the defects would have been obvious to him, this was a reflection on his conduct as a Driver and brought into question his integrity and fitness to be a licensed driver.Os gwyddai bod yna ddiffygion, ac ym marn y pwyllgor y farn oedd y byddai llawer o'r diffygion wedi bod yn amlwg iddo, mae hyn yn adlewyrchiad ar ei ymddygiad fel Gyrrwr, a chwestiynwyd ei uniondeb a’i addasrwydd i fod yn yrrwr trwyddedig. The committee felt that the Driver had a flagrant disregard for his duties and responsibilities as a driver licensed to drive members of the travelling public.Teimlai'r pwyllgor fod y Gyrrwr wedi diystyru ei ddyletswyddau a'i gyfrifoldebau fel gyrrwr trwyddedig i yrru aelodau teithiol o'r cyhoedd.

 

The Council revoked the licence pursuant to Section 61 (1) (b) on the basis of any other reasonable cause.Dirymwyd y drwydded yn unol ag Adran 61 (1) (b) gan y Cyngor ar sail unrhyw achos rhesymol arall.  Furthermore, pursuant to Section 61 (2B), as occurred in this case, it was considered that there was an immediate risk to public safety and as such the revocation needed to take place immediately.Ar ben hynny, yn unol ag Adran 61 (2B), fel y digwyddodd yn yr achos hwn, ystyriwyd bod yna berygl uniongyrchol i ddiogelwch y cyhoedd ac, o ganlyniad, bu’n rhaid i ddirymiad ddigwydd ar unwaith. 

 

The grounds of public safety were met in the opinion of the committee because he had disregarded his responsibilities by failing to look after his vehicle.Ni fodlonwyd sail diogelwch y cyhoedd ym marn y pwyllgor am ei fod wedi diystyru ei gyfrifoldebau drwy fethu i edrych ar ôl ei gerbyd.

 

·         he presented his vehicle for a test when it failed on 4 April 2016.cyflwynodd ei gerbyd am brawf pan fethodd ar 4 Ebrill 2016.

·         he presented the vehicle for an MOT test and compliance test when it would have been obvious to anyone (let alone a professional driver) that there were defects with the vehicle.cyflwynodd y cerbyd am brawf MOT a phrawf cydymffurfiad pan fyddai wedi bod yn amlwg i unrhyw un (heb sôn am yrrwr proffesiynol) bod yna ddiffygion gyda'r cerbyd.

·         the serious and dangerous condition of the vehicle itself.cyflwr difrifol a pheryglus y cerbyd ei hun.

·         his previous disregard for his vehicle having been issued with 20 penalty points the previous year and being suspended for two weeks at that time.ei ddiystyrwch blaenorol i’w gerbyd ar ôl cael 20 o bwyntiau cosb y flwyddyn flaenorol a chael ei atal dros dro yr adeg honno am bythefnos.

 

The committee’s decision and reasons therefore were conveyed to the Driver and his Union Representative together with the right of appeal against the decision.Cafodd penderfyniad y pwyllgor a’u rhesymau dros hynny eu cyfleu i’r Gyrrwr a’i Gynrychiolydd Undeb, ynghyd â’r hawl apelio yn erbyn y penderfyniad.
