Ystyried adroddiad cyfrinachol gan y Pennaeth Cynllunio a Diogelu’r Cyhoedd (copi ynghlwm) yn gofyn i aelodau benderfynu ar gais am Drwydded Cerbydau Hurio Preifat. 

PENDERFYNWYD bod y cais ar gyfer Trwydded Cerbyd Hurio Preifat yn cael ei gymeradwyo yn amodol ar yr amodau ychwanegol a nodwyd yn Atodiad 2 yr adroddiad.

{0>A report by the Head of Planning and Public Protection (previously circulated) was submitted upon –<}0{>Cyflwynwyd adroddiad gan y Pennaeth Cynllunio a Gwarchod y Cyhoedd (wedi ei gylchredeg yn flaenorol) ar -<0}

(i)            {0>an application having been received for a Private Hire Vehicle Licence;<}0{>gais a dderbyniwyd am Drwydded Cerbyd Hurio Preifat;<0}

(ii)          {0>officers having not been in a position to grant the application as the vehicle presented for licensing did not comply with the Council’s policy with regard to the five year age limit for vehicles licensed under a new application;<}0{>swyddogion wedi methu caniatáu’r cais gan nad oedd y cerbyd a gyflwynwyd i’w drwyddedu yn cydymffurfio â pholisi’r Cyngor mewn perthynas a’r  terfyn oed o bum mlynedd i gerbydau oedd i’w trwyddedu dan gais newydd;  <0}

(iii)         {0>additional conditions being applicable to the licensing of specialist vehicle types such as the one presented in this case together with photographs of the vehicle subject of the application, and<}0{>amodau ychwanegol perthnasol i drwyddedu mathau o gerbydau arbenigol megis yr un dan sylw yn yr achos hwn ynghyd â ffotograffau o'r cerbyd oedd yn sail ir cais, a <0}

(iv)         {0>the Applicant having been invited to attend the meeting in support of the application and to answer members’ questions thereon.<}0{>yr Ymgeisydd â wahoddwyd i fod yn bresennol yn y cyfarfod er mwyn cefnogi’r cais ac ateb cwestiynau'r aelodau.<0}

{0>The Applicant was in attendance and confirmed he had received the report and committee procedures.<}0{>Roedd yr Ymgeisydd yn bresennol a chadarnhaodd ei fod wedi derbyn yr adroddiad ynghyd â gweithdrefnau’r pwyllgor.<0}

{0>The Licensing Officer presented the report and drew attention to the Council’s policy which specified that vehicles subject of a new application must be no older than five years.<}0{>Cyflwynodd y Swyddog Trwyddedu’r adroddiad gan ddenu sylw’r pwyllgor at bolisi'r Cyngor oedd yn nodi fod rhaid i gerbydau oedd yn sail i gais newydd fod yn iau na phum mlwydd oed.<0}  {0>As the vehicle subject of the application was thirteen years old it did not comply with current specifications.<}0{>Gan fod y cerbyd dan sylw yn dair ar ddeg oed nid oedd yn cydymffurfio â’r gofynion presennol.<0} {0>Members were asked to consider the Applicant’s request to depart from the Council’s policy and grant the application.<}0{>Gofynnwyd i'r Aelodau ystyried cais yr Ymgeisydd i wyro oddi wrth bolisi’r Cyngor a chaniatáu’r cais.  <0}

{0>The Applicant advised of his intention to substitute a different vehicle for licensing but on reflection he confirmed his original vehicle licence application, details of which had been contained within the committee report.<}0{>Nododd yr Ymgeisydd ei fwriad i amnewid cerbyd arall i’w drwyddedu ond ar ôl ystyried y mater cadarnhaodd ei fwriad i fwrw ymlaen gyda'r cais gwreiddiol, oedd wedi ei nodi yn yr adroddiad i'r pwyllgor. <0}  {0>In presenting his case the Applicant advised that he was a well-known and established operator of limousines for specialist private hire purposes catering for special occasions such as weddings, christenings, etc.<}0{>Wrth gyflwyno ei achos nododd yr ymgeisydd ei fod wedi hen ennill ei blwyf ac yn adnabyddus fel gweithredwr ceir limwsîn ar gyfer hurio preifat arbenigol. Roedd yn darparu cerbydau ar gyfer achlysuron arbennig megis priodasau, bedyddiadau, ayyb. <0}  {0>He acknowledged the reasoning behind the introduction of an age limit for general hackney carriage and private hire vehicle licensing but submitted that the restriction had a disproportionate effect on his business and its viability given the nature and type of business operated and also created a barrier to upgrading existing licensed vehicles which had occurred in this case.<}0{>Er ei fod yn derbyn fod rheswm dros gyflwyno terfyn oedran ar gyfer trwyddedu cerbydau hacni cyffredinol a cherbydau hurio preifat teimlai fod y cyfyngiadau’n cael effaith anghyfartal ar ei fusnes a'i hyfywedd o ystyried y natur a'r math o waith a redai ynghyd â bod yn rwystr i uwchraddio trwyddedau cerbydau presennol fel oedd wedi digwydd yn yr achos hwn.<0}{0>He elaborated upon the merits of the proposed vehicle for licensing and provided evidence of maintenance and service schedules together with assurances regarding high vehicle standards.<}0{>Ymhelaethodd ar rinweddau’r cerbyd a gynigiwyd i’w drwyddedu a chyflwynodd dystiolaeth o waith cynnal a chadw a manylion gwasanaeth a thriniaeth ynghyd a sicrhau’r aelodau fod y cerbyd o safon uchel.<0}  {0>Finally he called for the removal of the age limit for specialist vehicle types, such as stretch limousines, in the Council’s policy.<}0{>Yn olaf gofynnodd am gael gwared o’r terfyn amser ar gyfer cerbydau arbenigol, megis limwsînau estynedig, ym mholisi’r Cyngor. <0}

{0>At this juncture the committee adjourned to consider the application and it was –<}0{>Yn y man hwn, cafwyd gohiriad er mwyn ystyried y cais. <0}

{0>RESOLVED that the application for a Private Hire Vehicle Licence be granted subject to the additional conditions as detailed in Appendix 2 to the report.<}0{>PENDERFYNWYD caniatáu’r cais am drwydded Cerbyd Hurio Preifat gan osod yr amodau ychwanegol fel y nodir yn Atodlen 2 i’r adroddiad. <0}

{0>The reasons for the Licensing Committee’s decision were as follows –<}0{>Roedd y rhesymau dros benderfyniad y Pwyllgor Trwyddedu fel a ganlyn - <0}

{0>Members had carefully considered the case put forward by the Applicant and noted that he was a long standing responsible operator of specialist high quality private hire vehicles for specific purposes.<}0{>Roedd yr aelodau wedi ystyried yr achos a gyflwynwyd yn ofalus ac wedi nodi fod yr ymgeisydd yn weithredwr cyfrifol oedd yn rhedeg y busnes ers amser hir, roedd ganddo  gwmni cerbydau hurio preifat i bwrpas penodol ac o safon uchel.<0}  {0>Having taken into account the nature and type of business operated by the Applicant and specific services provided, and having considered the proposed vehicle for licensing to be in pristine condition, members agreed that a case had been made to deviate from their age limit policy in this instance and grant the application as applied for, subject to the additional conditions applicable to the specialist vehicle type.<}0{>Wedi ystyried y natur a'r math o fusnes a redai’r ymgeisydd a’r gwasanaethau penodol a ddarperir, a gan dderbyn fod y cerbyd dan sylw mewn cyflwr arbennig o dda, cytunodd yr aelodau fod achos teilwng wedi ei gyflwyno i wyro oddi wrth eu polisi ar derfynau oedran cerbydau yn yr achos hwn a chaniatáu’r cais fel y gwnaed ef, gan osod amodau penodol yn berthnasol i'r math arbennig o gerbyd.<0} {0>With regard to the call for a change in the age limit policy relating to specialist vehicles, members reaffirmed their existing policy with each application to be considered on its own merits.<}0{>Ynglŷn â'r cais i newid y polisi ar derfyn oedran i gerbydau arbenigol, teimlai’r aelodau fod eu polisi presennol yn gywir ac y dylai pob un cais gael ei ystyried yn unigol. <0}

{0>The Committee’s decision and reasons therefore were conveyed to the Applicant.<}0{>Felly cafodd penderfyniad y Pwyllgor ynghyd â’r rhesymau eu cyfleu i’r Ymgeisydd. <0}
