CAIS AM DRWYDDED CERBYD HACNI

I ystyried adroddiad, yn cynnwys atodiad cyfrinachol, gan y Pennaeth Cynllunio a Gwarchod y Cyhoedd (copi wedi ei amgáu) yn ceisio penderfyniad gan yr aelodau ar gais gan Berchennog Cerbydau Hacni am drwyddedu cerbyd i bwrpas trwyddedu cerbydau hacni.

 

Penderfyniad:

PENDERFYNWYD bod y Pwyllgor Trwyddedu yn -

 

(a)       gwyro oddi wrth polisi cyfredol y Cyngor i gymeradwyo’r cerbyd yn addas i’w drwyddedu fel cerbyd hacni, a

 

(b)       manyleb y polisi cyfredol yn berthnasol i’r gofyniad lleiafswm ar gyfer gofod coesau i’w adolygu cyn gynted ag y bo’n ymarferol.

{0>[At this point the Applicant advised that he had not received the report and committee procedures and the meeting was adjourned to allow sufficient time for the Applicant to be furnished with all the relevant documentation and peruse them.<}0{>[Ar y pwynt hwn dywedodd yr ymgeisydd nad oedd wedi derbyn yr adroddiad na gweithdrefnau’r pwyllgor. Felly, cafodd y cyfarfod ei ohirio er mwyn rhoi amser iddo dderbyn a darllen y dogfennau perthnasol.<0} {0>Upon resuming proceedings the Applicant confirmed he was happy to continue.]<}0{>Ar ôl ailddechrau’r cyfarfod cadarnhaodd yr Ymgeisydd ei fod yn fodlon parhau.]<0}

 

{0>The Public Protection Business Manager presented the report and explained that the Applicant had approached the Council with a view to licensing a number of new vehicles to fleet – Dacia Logan estate cars – which had a measured leg room of 157mm.<}0{>Cyflwynodd Rheolwr Busnes Gwarchod y Cyhoedd yr adroddiad ac eglurodd bod yr ymgeisydd wedi cysylltu â’r Cyngor gyda’r bwriad o drwyddedu nifer o gerbydau newydd i’w fflyd - ceir stad Dacia Logan - sydd â gofod coesau o 157mm.<0} {0>The vehicles had been rejected because they did not comply with the Council’s current policy which specified a minimum 200mm leg room for passengers.<}0{>Roedd y cerbydau wedi eu gwrthod gan nad oeddynt yn cydymffurfio â pholisi presennol y Cyngor sy’n nodi bod angen o leiaf 200mm o ofod coesau ar gyfer teithwyr.<0} {0>The policy had become effective from 1 July 2017 and had been introduced to provide clarity to licensees and consistency of the standard of vehicles being licensed.<}0{>Daeth y polisi i rym ar 1 Gorffennaf 2017 i ddarparu eglurder i ymgeiswyr a chysondeb o ran safon y cerbydau sy’n cael eu trwyddedu.<0} {0>It was noted that there were already a number of other vehicles licensed prior to adoption of the current policy which would also fall foul of the new specification at renewal time and compliance testing.<}0{>Dywedwyd bod yna eisoes nifer o gerbydau wedi eu trwyddedu cyn mabwysiadu’r polisi presennol, cerbydau na fyddant yn cydymffurfio â’r fanyleb newydd pan fydd hi’n adeg eu hail drwyddedu a gwirio eu cydymffurfedd.<0} {0>Members would therefore need to balance the interests and opinion of the Applicant with possible implications on Denbighshire’s taxi fleet and the potential for an increased number of similar requests from applicants in the future when considering the application.<}0{>Felly, wrth ystyried y cais, bydd yn rhaid i aelodau gydbwyso budd a barn yr ymgeisydd gyda goblygiadau posibl ar fflyd tacsis Sir Ddinbych a’r posibilrwydd o dderbyn mwy o geisiadau o’r fath gan ymgeiswyr yn y dyfodol. <0}

 

{0>The Applicant set out his case and questioned the validity of the specification relating to leg room which he believed was too restrictive given that it served no purpose in improving the standard of vehicles used or impact on public safety implications.<}0{>Cyflwynodd yr ymgeisydd ei achos a holi ynghylch dilysrwydd y fanyleb o ran y gofynion gofod coesau sydd, yn ei farn ef, yn rhy gyfyngol o ystyried nad yw’n gwella safonau cerbydau a ddefnyddir nac yn effeithio ar ddiogelwch y cyhoedd. <0}{0>He also argued that the condition resulted in the exclusion of the majority of medium and large saloon and estate cars being suitable for licensing and submitted that there were licensed vehicles in Denbighshire and other local authority areas which did not meet the current specification but provided ample leg room for passengers and it was unlikely that the vehicles would ever operate with the seats fully extended.<}0{>Dadleuodd hefyd bod yr amod hwn yn eithrio’r rhan fwyaf o geir salŵn a stad canolig a mawr rhag bod yn addas ar gyfer eu trwyddedu. At hynny dywedodd nad yw cerbydau trwyddedig eraill yn Sir Ddinbych ac ardaloedd awdurdodau lleol eraill yn bodloni’r gofynion presennol ond yn darparu digon o ofod coesau ar gyfer teithwyr, fodd bynnag, dywedodd nad yw’n debygol bod y cerbydau hyn yn gweithredu gyda’r seddi ar y gosodiad sy’n darparu’r gofod coesau mwyaf.<0} {0>He believed that if those matters had been brought to members’ attention at the outset the restriction would not have been introduced.<}0{>Credodd pe byddai’r materion hynny wedi eu dwyn i sylw’r aelodau yn y cychwyn cyntaf na fyddai’r cyfyngiad wedi ei gyflwyno.<0} {0>The Applicant also provided details of his specific business and its operation, with particular reference to his planned investment in order to upgrade the fleet and improve vehicle standards, arguing that the new vehicles were clean and modern with a lower carbon footprint and represented best value for his business and the customer.<}0{>Darparodd yr ymgeisydd fanylion ei fusnes a’i wasanaeth penodol, gan gyfeirio at ei fuddsoddiad cynlluniedig i ddiweddaru ei fflyd a gwella safonau cerbydau. Dywedodd bod y cerbydau newydd yn lân a modern gydag ôl-troed carbon is ac yn darparu’r gwerth gorau i’w fusnes a’i gwsmeriaid. <0}{0>Mr.<}100{>Siaradodd Mr<0} {0>Higginson also spoke in support of the Applicant and he urged members to consider that neighbouring authorities licensed vehicles of that type and that the licensed trade should be given appropriate notice of any changes to vehicle specifications.<}0{>Higginson o blaid yr ymgeisydd ac anogodd yr aelodau i ystyried bod awdurdodau cyfagos yn trwyddedu cerbydau o’r fath ac y dylid rhoi cyfnod rhybudd priodol i’r fasnach drwyddedig cyn gwneud unrhyw newid i fanyleb cerbydau. <0}

 

{0>The Chair invited the Fleet Compliance Engineer to advise members on the measurements for leg room and he provided a prop for members to use as a visual aid to highlight the range difference between the minimum 200mm specification and 150mm.<}0{>Gwahodd y Cadeirydd y Peiriannydd Cydymffurfiaeth Fflyd i ddarparu cyngor i’r aelodau ar y mesurau gofod coesau. Darparodd ateg i’r aelodau gael syniad o’r gwahaniaeth rhwng gofod o 200mm a gofod o 150mm.<0}{0>The minimum 200mm specification had been derived from a number of processes including what had been considered fair and reasonable measurements and related to when the front seat had been extended to its rearmost position.<}0{> Mae’r gofyniad o 200mm (o leiaf) yn ganlyniad i nifer o brosesau, gan gynnwys y mesuriadau a ystyriwyd yn deg a rhesymol pan fo’r cadeiriau blaen ar y gosodiad pellaf o’r panel deialau.<0}{0>In response to a question from the Chair the Fleet Compliance Engineer advised that the current minimum seat spacing on fleet ranged from 60mm to 270mm with the differences being predominantly attributed to the runner used by different manufactures together with the seating type which gave a varied amount of leg room.<}0{> Mewn ymateb i gwestiwn gan y Cadeirydd dywedodd y Peiriannydd Cydymffurfiaeth Fflyd bod gofod coesau cerbydau yn amrywio o 60mm i 270mm, gyda’r prif wahaniaeth dros hyn yn ymwneud â’r rhedwr a ddefnyddir gan wahanol wneuthurwyr yn ogystal â math y cadeiriau.<0}{0>It was acknowledged that the rear seats in the vast majority of vehicles fell below the minimum 200mm specification when the front seat was fully extended.<}0{> Cydnabyddir bod seddau cefn y rhan fwyaf o gerbydau yn darparu gofod coesau llai na 200mm pan fo’r sedd flaen ar y gosodiad pellaf. <0}

·         {0>physical alterations to seat runners would weaken the structure and have serious safety implications, however it might be possible to place something in the runner to prevent the seat extending to its rearmost position<}0{>Byddai addasu rhedwyr seddau yn gwanhau’r strwythur ac yn cael effaith ddifrifol ar ddiogelwch, fodd bynnag efallai byddai modd gosod rhywbeth ar y rhedwr i atal y sedd flaen rhag mynd yn ôl gormod <0}

·         {0>the prospect of the authority being able to influence vehicle manufactures with respect to those measurements was unrealistic given that vehicles were type approved and subject to rigorous testing<}0{>Mae gallu’r awdurdod i ddylanwadu ar wneuthurwyr cerbydau o ran y mesuriadau hyn yn afrealistig iawn, o ystyried bod y cerbydau yn cael eu cymeradwyo ac yn destun profion manwl<0}

·         {0>explained the comprehensive consultation process since starting the review of hackney carriage and private hire conditions in 2015 which involved two workshops and consultation with all interested parties including the licensed trade on two separate occasions with further updates provided in newsletters to licence holders with final approval by Licensing Committee in December 2016 and implementation of the policy on 1 July 2017<}0{>Eglurwyd y broses ymgynghori gynhwysfawr a gynhaliwyd ers dechrau adolygu amodau cerbydau hacni a cherbydau hurio preifat yn 2015, a oedd yn cynnwys dau weithdy ac ymgynghoriad gyda’r holl bartïon a diddordeb, gan gynnwys y fasnach drwyddedig ar ddau achlysur ar wahân. Yn ogystal, darparwyd diweddariadau pellach mewn newyddlenni i ddeiliaid trwydded. Cafodd yr amodau terfynol eu cymeradwyo gan y Pwyllgor Trwyddedu ym mis Rhagfyr 2016, a daeth y polisi i rym ar 1 Gorffennaf 2017<0}

·         {0>officers were available to provide advice and guidance and were regularly approached in that regard – potential vehicles for licensing were also assessed free of charge to ensure specifications were met before individuals committed to financial outlay<}0{>Roedd swyddogion ar gael i ddarparu cyngor a chyfarwyddyd a chysylltwyd â hwy’n rheolaidd yn hynny o beth – roedd cerbydau hefyd yn cael eu hasesu’n rhad ac am ddim i sicrhau eu bod yn bodloni’r gofynion cyn i unigolion ymrwymo i unrhyw gontract ariannol <0}

·         {0>the leg room for the front seat passenger was not in question and in the normal operating position those vehicles would meet the leg room requirement<}0{>Nid yw gofod coesau teithwyr y seddi blaen yn cael ei gwestiynu ac ar y gosodiad gweithredu arferol byddai’r cerbydau hynny yn bodloni’r gofynion gofod coesau <0}

·         {0>there was no grace period for the leg room specification and vehicles currently licensed which did not meet the new specification upon renewal or compliance testing would no longer be able to be licensed.<}0{>Nid oes cyfnod ewyllys da ar gyfer y fanyleb gofod coesau a byddai cerbydau trwyddedig nad ydynt yn bodloni’r gofynion ar adeg adnewyddu eu trwyddedau neu yn ystod prawf cydymffurfiaeth yn cael eu hail-drwyddedu. <0}{0>It was accepted that the new ruling would affect a large number of vehicles currently licensed including models such as Ford Mondeo, BMW 5 Series and Skoda Octavia.<}0{>Derbyniwyd bod y rheol newydd yn effeithio ar nifer fawr o gerbydau trwyddedig, gan gynnwys modelau fel Ford Mondeo, BMW 5 Series a Skoda Octavia<0}

·         {0>in terms of passenger comfort a computerised monitoring system was used when taking bookings with mobility and other issues being noted and an appropriate vehicle sent to fulfil the booking<}0{>O ran bod yn gyfforddus, defnyddiwyd system fonitro gyfrifiadurol wrth gymryd archebion, gan nodi materion symudedd ac eraill a sicrhau bod cerbyd priodol yn cael ei ddefnyddio i gludo cwsmeriaid<0}

·         {0>he had engaged with the consultation process on the policy review but given the wealth of information and major changes considered in terms of vehicle age and colour the new leg room requirement and its significance had gone unnoticed<}0{>Roedd wedi cymryd rhan yn y broses ymgynghori ynghylch adolygu’r polisi ond o ystyried yr wybodaeth a’r newidiadau mawr o ran oedran a lliw, ni fu iddo sylwi ar y gofynion o ran gofod coesau <0}

·         {0>the Dacia Logan model had not been checked for seat compliance beforehand because he had been unaware of the new leg room condition and its implications, particularly given that the same vehicle type was currently licensed by the Council<}0{>Nid oedd wedi gwirio model Dacia Logan o ran gofod coesau gan nad oedd yn ymwybodol o’r amod newydd a’r goblygiadau, yn enwedig gan fod y math hwn o gerbyd yn cael ei drwyddedu gan y Cyngor<0}

·         {0>the Dacia Logan had been chosen for licensing because it was a medium estate car with good luggage space which met the needs of customers and also provided value for money, and the intention was to replace and modernise the existing fleet with those vehicles – there were currently six two year old vehicles awaiting licensing with four more new vehicles currently on order<}0{>Roedd y Dacia Logan wedi ei ddewis i’w drwyddedu oherwydd ei fod yn gar stad maint canolig gyda diogon o le i fagiau, sy’n diwallu anghenion cwsmeriaid, ac oherwydd ei fod yn darparu gwerth am arian. Y bwriad oedd amnewid a moderneiddio’r fflyd bresennol gyda’r cerbydau hynny – ar hyn o bryd mae yna chwe cherbyd dwy oed yn aros am gael eu trwyddedu a phedwar cerbyd newydd arall ar archeb <0}

·         {0>the new ruling would affect the vast majority of vehicles currently licensed and have a devastating effect on the licensed trade.<}0{>Byddai’r rheol newydd yn effeithio ar y rhan fwyaf o’r cerbydau trwyddedig presennol, ac yn cael effaith niweidiol ar y fasnach drwyddedig <0}

 

{0>The Applicant was given the opportunity to make a final statement and indicated that he had nothing further to add.<}68{>Rhoddwyd cyfle i’r ymgeisydd wneud datganiad terfynol, ond dywedodd nad oedd ganddo unrhyw beth arall i’w ychwanegu.<0}

{0>The reasons for the Licensing Committee’s decision were as follows –<}100{>Dyma oedd y rhesymau dros benderfyniad y Pwyllgor Trwyddedu – <0}

 

{0>Members had carefully considered the case as set out by the Applicant and accepted that he had bought a number of vehicles which were economic, safe, modern, more environmentally friendly, and improved the existing fleet.<}0{>Roedd yr aelodau wedi ystyried achos yr ymgeisydd yn ofalus iawn ac yn derbyn ei fod wedi prynu sawl cerbyd sy'n economaidd, diogel, modern, yn fwy ecogyfeillgar ac yn gwella’r fflyd bresennol.<0} {0>The Applicant had admitted that he had failed to notice the significance of the leg room requirement in the policy because of the wealth of new information it contained and the concern amongst the trade had been focused around the age/colour requirements of vehicles.<}0{>Roedd yr ymgeisydd wedi cyfaddef nad oedd wedi sylwi ar arwyddocâd y gofyniad o ran gofod coesau oherwydd yr holl wybodaeth newydd yn y polisi a’r pryder oedd gan fasnachwyr ynghylch oed/lliw cerbydau.<0} {0>Members considered that in practical terms the leg room requirement meant that a large proportion of licensed vehicles would be removed from the road.<}0{>Mewn gwirionedd, mae’r gofyniad o ran gofod coesau yn golygu y byddai nifer fawr o gerbydau trwyddedig yn cael eu tynnu o’r ddarpariaeth. <0}{0>Consequently members found that the policy had unintended consequences on the industry and appeared unduly restrictive and on that basis they would be calling for a review of the policy in order to assess the impact across the trade.<}0{>O ganlyniad teimlodd yr aelodau bod y polisi yn cael canlyniadau anfwriadol ar y diwydiant ac yn ymddangos yn gyfyngol iawn. Oherwydd hynny, byddant yn galw am adolygiad o’r polisi er mwyn asesu'r effaith ar draws y diwydiant.<0} {0>On this occasion though and specifically in relation to the Applicant’s vehicles, members agreed to deviate from the policy to approve them as suitable to be licensed.<}0{>Ar yr achlysur hwn, yn arbennig o ran cerbydau’r ymgeisydd, cytunodd yr aelodau i wyro oddi wrth y polisi a chymeradwyo’r cerbydau fel cerbydau addas i’w trwyddedu. <0}

 

{0>The committee’s decision and reasons therefore were conveyed to the Applicant.<}100{>Cafodd penderfyniad y pwyllgor a'r rhesymau eu cyfleu i'r ymgeisydd.<0}
